Terms of Service

1. Agreement and operator
These Terms of Service ("Terms") govern your access to and use of profootballmodels.com and related services (collectively, the "Service"). The Service is operated by Pro Football Models ("PFM," "we," "us," or "our").
By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms and acknowledge the Privacy Policy and Disclaimers. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and legally capable of entering a binding contract to create an account or purchase a subscription. Betting-related content is intended only for people who are at least 21, or the higher legal gambling age in their jurisdiction. You may not use the Service where doing so is prohibited by law.
PFM is an analytics and publishing service. PFM is not a sportsbook, casino, gambling operator, bookmaker, financial institution, investment adviser, or fiduciary. PFM does not accept wagers or hold gambling funds.
3. Accounts and account security
Some features require a passwordless account using an email verification link. You agree to provide accurate information, keep access to your email account secure, and promptly notify us at Profootballmodels@proton.me if you suspect unauthorized access. You are responsible for activity through your account unless prohibited by law.
Display names and other profile information must not impersonate another person, violate law, infringe rights, contain malicious content, or be abusive or misleading. We may remove prohibited content or suspend an account when reasonably necessary to protect the Service or other users.
4. Analytics, projections, and picks
PFM publishes statistical analysis, models, rankings, projections, fantasy information, odds information, survivor analysis, and editorial selections. These outputs are estimates based on data, assumptions, and methods that may be incomplete, delayed, incorrect, or changed without notice.
Nothing on the Service is a guarantee, a promise of profit, or individualized betting, financial, investment, legal, tax, or medical advice. Past performance does not guarantee future results. You are solely responsible for decisions you make using the Service, including confirming current odds, injuries, lineups, rules, and legal eligibility with authoritative sources.
User pick-tracking and leaderboards are entertainment and recordkeeping features. Unless a separate written promotion expressly states otherwise, they are not gambling contests, do not require a wager, and do not award cash prizes.
5. Paid subscriptions
PFM may offer recurring subscriptions that unlock premium content or features. Before purchase, the checkout page will identify the price, billing interval, included features, and any trial or promotional terms.
- Subscriptions automatically renew for successive billing periods until canceled.
- You authorize PFM and its payment processor, Stripe, to charge the payment method associated with your account at each renewal.
- You may cancel through the account billing portal. Cancellation prevents future renewal and ordinarily leaves access active through the end of the paid billing period.
- Except where required by law or expressly stated at checkout, fees already paid are nonrefundable and PFM does not provide prorated refunds for unused time.
- We may change future subscription prices after reasonable advance notice. A changed price applies no earlier than the next renewal permitted by that notice and applicable law.
Business decision required: Replace this paragraph with the final refund policy, trial policy, and cancellation notice timing after counsel reviews the states in which subscriptions will be sold.
Payment-card information is collected and processed by Stripe through its hosted services. PFM does not intend to store complete payment-card numbers on its own servers.
6. Acceptable use
You may use the Service only for lawful personal or internal business purposes. You may not:
- copy, republish, sell, sublicense, or create a competing dataset or service from PFM content except with written permission;
- scrape, crawl, harvest, or extract content at scale, or bypass rate limits or access controls;
- reverse engineer nonpublic models, interfere with the Service, introduce malicious code, or probe for vulnerabilities without authorization;
- use automated means to create accounts, manipulate leaderboards, submit picks, or abuse promotions;
- use the Service to violate gambling, consumer-protection, intellectual-property, privacy, or other laws; or
- misrepresent PFM content as official NFL data, a guaranteed outcome, or professional advice.
Limited quotation and sharing may be allowed by law. PFM may publish additional API, attribution, or content-sharing rules.
7. Intellectual property
PFM and its licensors retain all rights in the Service, including its original text, graphics, software, databases, models, formulas, PFM metrics, branding, and presentation. These Terms provide a limited, revocable, nonexclusive, nontransferable right to use the Service; they do not transfer ownership.
NFL, team, player, and third-party names, logos, statistics, and marks belong to their respective owners. Their appearance does not imply sponsorship or endorsement unless expressly stated.
If you believe material on the Service infringes your rights, send a notice to Profootballmodels@proton.me with sufficient information to identify the work, challenged material, your contact information, and the basis of your claim.
8. Third-party services and links
The Service relies on or links to third parties, which may include data providers, email delivery, authentication, database hosting, analytics, payment processing, sportsbooks, and other websites. Their services and policies govern your direct interactions with them. A reference or link does not necessarily constitute endorsement. PFM is not responsible for third-party availability, content, odds, practices, or transactions.
9. Availability and changes
We may modify, correct, suspend, or discontinue all or part of the Service. We do not promise that content will always be accurate, complete, uninterrupted, secure, or available. We may correct errors, revise models, remove content, and change features without preserving earlier outputs.
10. Suspension and termination
You may stop using the Service at any time and may request account deletion as described in the Privacy Policy. We may restrict or terminate access for a material or repeated violation of these Terms, fraud, abuse, legal risk, nonpayment, or a threat to the Service or its users. Provisions that by their nature should survive termination—including intellectual-property, disclaimer, liability, and dispute provisions—will survive.
11. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available." PFM disclaims express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, and results. Some jurisdictions do not permit certain disclaimers, so portions of this section may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, PFM and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost opportunities, betting losses, or losses arising from reliance on Service content.
To the fullest extent permitted by law, PFM's aggregate liability arising from the Service or these Terms will not exceed the greater of (a) the amount you paid PFM during the six months before the event giving rise to the claim or (b) US $100.
These limitations do not exclude liability that cannot legally be excluded. Some jurisdictions provide rights that cannot be waived.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold PFM harmless from third-party claims arising from your unlawful use of the Service, your violation of these Terms, or your infringement of another person's rights. This provision does not apply to the extent a claim results from PFM's own conduct or where indemnification is prohibited.
14. Governing law and disputes
These Terms are governed by the laws of Virginia, without regard to conflict-of-law rules. Subject to applicable consumer rights, disputes will be brought in the state or federal courts located in Charlottesville City, Virginia, and each party consents to their jurisdiction.
15. Changes to these Terms
We may update these Terms. We will post the revised version and update its effective date. If a change materially affects registered users or paid subscriptions, we will provide additional notice when required. Continued use after the effective date constitutes acceptance to the extent permitted by law.
16. General terms
If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; PFM may assign them as part of a merger, acquisition, reorganization, or asset transfer. These Terms, together with incorporated policies and purchase terms, are the entire agreement concerning the Service.
